CASE UPDATE: Two Arrests Made Following Investigation into November 2025 Shooting

The Flagler County Sheriff’s Office has concluded its investigation into a November 2025 shooting that occurred at a Palm Coast apartment complex. The investigation resulted in two arrests.
On Nov. 16, 2025, the FCSO Major Case Unit responded to investigate a shooting at an apartment complex on Beach Village Circle in which two people — Micah McGill, then-17, and Tyree Smith, then-22 — sustained non-life-threatening gunshot wounds. The shooting happened during an altercation that followed a domestic disturbance between Smith and a family member of McGill’s.
During the investigation, detectives interviewed all parties involved to determine how the shooting occurred. McGill and Smith provided detectives with conflicting accounts of what happened. Additionally, McGill changed his statement, first telling detectives that he grabbed the gun before the encounter, then later stating that he had wrestled the gun from Smith.
At the conclusion of interviews and using evidence obtained during a search warrant with evidence collected by FCSO’s Crime Scene Investigation Unit, detectives determined that McGill shot Smith, then accidentally shot himself during the altercation.
During the initial investigation, detectives obtained a warrant for Smith’s arrest for battery from the domestic disturbance that preceded the shooting and arrested him on Nov. 18, 2025.
Detectives also determined McGill had an extensive juvenile criminal history and had been previously adjudicated a delinquent, making it a felony for him to possess a firearm.
Based on the FCSO investigation, the State Attorney’s Office requested a capias on McGill for aggravated battery with a deadly weapon, possession of a firearm by a delinquent, and shooting into a building. On June 4, the capias was approved and issued by Circuit Judge Dawn Nichols.
On July 7, the FCSO Fugitive Apprehension Unit located McGill, now 18, at a residence on Ripplet Place in Palm Coast and he was arrested without incident.

“This investigation was a lot more complicated than it needed to be and took a lot longer than it needed because the people involved did not want to be cooperative or be truthful how this shooting occurred,” said Sheriff Rick Staly. “Despite their attempts to cover up the incident, our Major Case Unit continued to investigate until the truth was proven and an arrest was made. I commend everyone involved for their perseverance during this investigation.”
McGill was transported to the Sheriff Perry Hall Inmate Detention Facility, where he is being held on a $105,000 bond.
Smith, now 23, later entered into a deferred prosecution agreement with the State Attorney’s Office, which included the completion of an anger management course. Upon completion of the deferred prosecution agreement in March, the battery charge was dismissed by the State Attorney’s Office.
